By accessing our website or purchasing any products, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our website.
1. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts.
By placing an order, you confirm that:

Physical goods (UK only, where stated)
Digital products are supplied by instant download and/or email delivery.
Digital content is deemed delivered when:

Download access is made available;
-
Access credentials are issued; or
-
The content is made accessible via your account or email.
3. Licence for Digital Products
Unless otherwise agreed in writing:

You are granted a non-exclusive, non-transferable, revocable licence for personal use only.

Commercial manufacturing, resale, distribution, or monetisation of products built from our designs is prohibited without a separate written commercial licence.
You may not:

Resell or redistribute files;
-
Share files publicly or privately;

Upload files to third-party platforms;

Modify and resell designs as your own;
-
Remove copyright or branding notices.
All intellectual property rights remain our property.
We reserve the right to revoke access where licence terms are breached.
4. No Professional Advice
All content is provided for general informational and educational purposes only.
Our plans, files, and materials:

Do not constitute professional engineering advice;

Do not constitute certified electrical advice;

Do not constitute structural or building regulation advice;

Are not a substitute for qualified professional consultation.
You are solely responsible for obtaining appropriate professional advice where required.
5. Compatibility and Skill Responsibility
It is your responsibility to ensure:

You possess sufficient skill and competence;

Your tools and equipment are suitable and safe;

Your hardware and software are compatible with digital files provided.
We do not guarantee compatibility with all devices, slicers, CAD software, operating systems, or third-party platforms.
6. Orders and Contract Formation
An order constitutes an offer to purchase.
A binding contract is formed only when we confirm acceptance.
We reserve the right to:

Refuse or cancel orders;

Limit quantities;
-
Cancel suspected fraudulent, abusive, or resale purchases.
If payment has been taken for a cancelled order, it will be refunded.
7. Digital Content – Cancellation and Refunds
Under the Consumer Contracts Regulations 2013, UK consumers normally have a 14-day cancellation right.
This right is lost once digital content supply begins, provided that:

You request immediate access; and

You acknowledge loss of cancellation rights.
By completing checkout and accessing digital content, you expressly consent to immediate supply and acknowledge loss of cancellation rights.
If digital content is faulty or materially not as described, remedies will be provided in accordance with the Consumer Rights Act 2015.

8. Physical Goods (UK Only)
Where physical goods are sold:

Delivery is limited to the United Kingdom;

Estimated delivery timeframe is approximately 7 days unless otherwise stated;

Risk passes upon delivery;

Consumers have a 14-day cancellation right;

Return shipping is the customer’s responsibility unless goods are faulty.
Nothing in these Terms affects statutory rights under the Consumer Rights Act 2015.
9. Safety and Assumption of Risk

By purchasing or using our products, you:

Nothing excludes liability for:

10. Limitation of Liability

You agree to indemnify and hold harmless WAVESEMBER LTD from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

Your breach of these Terms;

Your commercial exploitation without licence;

Any modifications you make to our designs;

Any claim brought by a third party resulting from your construction or use.
12. Accounts and User Content
You are responsible for maintaining account security.
Where you submit content, you grant us a worldwide, royalty-free licence to use, reproduce, and publish such content for marketing and operational purposes.
We reserve the right to remove content at our discretion.
13. Payments
Payments may be processed through:

We are not liable for payment processor errors or service interruptions.
14. International Sales and Export Compliance
Digital products may be sold worldwide except where prohibited by law.
You confirm that you are not located in, nor purchasing from, any jurisdiction subject to UK trade sanctions or export restrictions.
You are responsible for compliance with local laws in your jurisdiction.
15. Force Majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including platform outages, supply chain disruption, regulatory action, or natural disasters.
16. Termination
We may suspend or terminate access where you breach these Terms.
Termination does not affect accrued rights.
17. Entire Agreement
These Terms constitute the entire agreement and supersede prior communications.
18. Severability
If any provision is found invalid, the remainder remains enforceable.
19. Governing Law
These Terms are governed by the laws of England and Wales.
Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
